Weingarten Rights
Weingarten Rights guarantee union members the right to Union representation during an investigatory interview.
These rights were established by the Supreme Court but managers have no responsibility to let an employee know they have a right to union representation, so employees MUST INVOKE WEINGARTEN RIGHTS TO USE THEM. If called into a meeting with a supervisor, ask if this meeting could lead to disciplinary action. If your supervisor says “yes” or gives you ANY REASON to suspect that the meeting could be used against you later, invoke your Weingarten rights by saying: |
"If this discussion could in any way lead to my being disciplined or discharged, I request that my Union representative be present at the meeting. Without representation, I choose not to answer any questions."
